What is your legal right and how long do you have before the landlord can start eviction. The people are trying to pay and haven't been 30 days behind yet.

After a 3 day or quit notice has been served, the eviction process begins. besides rent they also owe for legal fees. The renter can refuse partial payment and demand all rent and fees be paid before the process is halted.

It varies form state to stat but I will tell you it works in Philadelphia, PA. After you rent is considered late which is generally the 5th of each month they must send you a notice letting you know that if the rent is not paid with the next 5 days a eviction will be filed. Once it gets filed on the 10th you will not get a court date until 10-15 days after the filed date. Once the date comes up on the 20th-25th the tenant can say they need more time to pay and they will give the tenant another 10-20 days to pay the rent. If it is not paid by the agreed date then the landlord can file what is called "a writ of possession" that is when they come out and put a pad lock on the door. From the date you file fir the writ they will lock it up exactly 5 days later. So if you know your right you can get away with it for about 2 months. Even longer if ask for extensions.

It depends on what state you live in, because different states have different laws. You don't have to be 30 days behind in your rent to get evicted. Typically, if your rent is due on the 1st after the 5th it is considered late.

How long after that depends on what is written in your lease agreement; however, the norm is 30 days before you can evict somebody, but your lease agreement should have a section that deals with this.

I remember one time when I first started renting apartments, I got behind on my rent, and I got an evection notice. I was able to pay my rent though, and put on probation with the apartments. If I was ever a day late for the next however long it was, I could be locked out of my apartment. I guess it just depends on the apartment manager and their policy. Good luck. PS-I learned my lesson that one time, and have NEVER been late for rent again, believe me, it scared the crap out of me lol.

Every state is completely different. But, there is no 30 day grace period. Apparently the landlord feels that sooner or later he will get stiffed. Pay up and move out.
