Hi guys! Basically I have this issue that's really bothering me. I just got into a car accident. Someone hit me in a parking lot by backing out. They didn't see me and just ran right into me. They begged me to settle this w/out the cops and I said no and called the cops (both the driver and passenger had their license suspended and no insurance). Cop came and half an hour later told me that because I was in a private parking lot, he cannot write them up for violation. Call my insurance and that was it. Does this sound right to you guys or is there something going on? Does that mean I can get a bat and smack the other guy's car w/out getting in trouble?
What should I do?

Just called my insurance company and I have to pay $500 for deductible. WTF is this, I got hit and I have to pay?!

Any police officer here other than #3? Thanks #3 but another question got into me. Doesn't the guy that hit me have to pay for my car or is this totally on me and my insurance? There is no LAW that says he has to ?!!

Sounds like he just didn't feel like doing paperwork.

They were DRIVING a car on a suspended license in a PARKING LOT. It wasn't their own, privately owned driveway, was it? If not, they should've been cited for DRIVING ON A SUSPENDED LICENSE and NO INSURANCE.

I'd call the P.D. and file a complaint 'cause me thinks you got hosed!!!!!!!!!

Most state statutes relate that accidents or driving violations may be cited when on a "public" roadway. Because this was a parking lot at a business location, it is upon "private" property.

Other criminal offenses may be enforced but "traffic" offenses are a different story if on other than a "public roadway."

The officer was accurate in telling you he couldn't write the offender for the suspended/revoked license.

Parking lots are considered private property. So yes, the police don't file anything unless there is an injury ( I think). Unfortunately, they got lucky. You will have to file with your insurance, or if you have their names and info...get an attorney. It'll cost you in the long run. Frustrating I know...but one of those loop holes of life.
