I have a friend that married someone to help them get their residency and now they got their papers and he wants to get a divorce...how can he file?

thank you all for your answers they were all great...my friend can't locate this person because she won't return his calls to sign the divorce papers so what can he do if he can't get a hold of her? does the court try to find her?

An annulment says that the marriage never happened. Erases it from the record. A divorce has the marriage and dissolution of marriage on file. Usually has to be a pretty good reason to grant an annulment. Divorces lately have become no-fault in many states and don't have to have a reason other than you don't get along.

If your friend married this person so they could stay in the United States legally, there is a time limit they have to stay married OR your friend could get into serious trouble with the government and the spouse could get deported.

An annulment is a declaration by a judge stating that the marriage never existed. You have to go to court for an annulment. An uncontested divorce means both parties sign and are not contesting anything from one another (such as child support, alimony, division of property). In other words, both parties leave with what they brought into the marriage.

An annulment has to be done in a certain amount of time after the marriage. Where I live, it's 6 months, and you have to be able to prove there was something about the other person you didn't know prior to marriage that, if you had known it, you wouldn't have married that person (i.e. abusive, alcoholic, drug addict, unfaithful, etc.). An annulment makes it look like legally the marriage never happened, which isn't what your buddy would want, considering if the marriage didn't happen, the other person wouldn't have obtained residency. He/she would have to as a lawyer, though. An uncontested divorce just means one person files and the other says "ok, we'll get a divorce" instead of asking the judge to refuse to grant the divorce, I think.

An annulment is when it is like the marriage never happened. A uncontested divorce is when no one is against the divorce happening. But if he got his papers then he is legal and able to file a divorce just like any American. Good Luck!!

Annulment goes down showing that basically the marriage never occured so you could say you were never married, an uncontested divorce is a divorce that both parties agree to the divorce and what the documents to the divorce state.

Annullments aren't normally granted if sex has occured. Otherwise they will have to file for divorce.

I know there are some religions that this makes a huge difference in. If its annulled they can still re-marry, but some ethnicities & religions won't accept a divorce.

used to be a annulment was you didnt consumate the marriage, I would think he could file for uncontested divorce, but the judge will want to see they dont live together, that is perjury,

An annulment is strictly a Catholic church procedure. A divorce proceding is related to the states recognition of the marriage.
