my husband was fired today he was aqusd of smoking marijuana (sorry in advance for spelling errors im angry) he was with another guy they both looked high and smelled of marijuana the boss ask both my husband who has been working ther 5 years said yea way earlier the other guy who has been there 4 month said heck no and my husband got sent home and they called today to say he was fired is there anything i can do to fight this?? we have a 5 month old i do not work? and the boss has know my husband had a drug prob since they started working together 5 years ago the same boss has even smoked with him on occasion and now hes firing my hubby for smoking what can i do HELP please serious answers only please and again sorry for the spelling im so frustrated

Sorry to hear he was fired. I am not anti-marijuana, but I am pretty sure they had a right to fire him for smoking it on the job. It is not to use during work hours. I think they shouls have drug tested the other guy and fire him too though.

It's a shame he was fired for being honest. Maybe he can find another job soon, maybe even a better one.

I would start out by talking with your husband first. A man doea not like his woman going behind his back to try to fix his problems. Call the Employment Security Commision of your state and tell them that he was fired for reasons that were unjust and unfair. Depending on your state's laws regarding the right to hire and fire, you will get one of two outcomes. One is that you can't do anything about it, legally or two the state will do an investigation. If there is no urinalysis or other legal documentation that your husband had used marijuana, the employer will have to rehire your husband. Aside from the legal ways, you could call the employer and tell him you are going to blackmail him. Threaten to go above his head and tell his supervisor that he was smoking marijuana. They will give him a drug test and, depending on how long its been, he'll pop positive for drug use. The idea of having his dirty laundry hung out so everybody can see it may lead him to reconsider his decision. Good luck, but in the meantime make sure your husband is avidly searching for gainful employment. It will look good to the Employment Commision as well.

Marijuana is not soo terribly addictive that anybody would HAVE to smoke at work. I'm sorry about your situation with the new baby in the house and all, but get it together! I'm a really young, single mom and I have worked since I was 15 years old. Where there is a will, there is a way. Good luck to you and your family. Btw...no labor laws are going to be on your side here.

he was fired for on the job smoking pot
plain and simple
and yes even tho the boss has used with him at other times on the job is another book

if someone got hurt the boss could get into trouble
how stupid to smoke on the job it is dangerous to do that anyone could get hurt for a # of reasons

little side note on the un-employment issue, assuming this is USA, but under states unemployment laws if a employee is fired for gross misconduct connected to the work they are ineligible to collect unemployment benefits, since smoking pot is a crime that would rise to the level of gross misconduct
but since they have no proof of this he should win on appeal if denied benefits, this assumes he does not show up for the appeal smelling like pot

Your husband's boss had every right to fire him if he was high at work. He can collect unemployment, and he'll have to look for another job. If the job wanted to they could of also called the police! It could of been a lot worse!!!

Its a bad situation all around. The labor laws are not wrtten to protect this kind of situation. Your husband using narcotics
at work is a felony. You are lucky he wasn't arrested and sent to jail.

well marijuana is illegal so i dont think there are any laws that make it legal at work. sorry.
