I need help. My exhusband was very abusive and when I left I got out in a hurry no place to live or even a job because he harrassed me and got me fired. I have been fighting for my child ever since. He goes into court and tells them lies about me and no one will do anything to defend me. I can not afford an attorney and he had the best attorney in San Diego. My daughter is suffering from this can any one out there help me. I have court docs to prove my side, he just keeps adding more lies and more lies and the court allows him to do it. PLEASE SOMEONE HELP ME!

It is my experience from years of practice that the truth has little to do with the outcome. The person with the best story, that can't be disproved by the other side, usually wins. In other words, if you can't prove that he is lying, he will probably win. The fact that he has an attorney and you don't is one sure way to put yourself at an insurmountable disadvantage. I have great sympathy for you because I have lost many cases for this same reason, being unable to prove the lies being told by the other side. You say you have documents to prove your story. You need an attorney to help you get them presented. You must go to a community legal clinic and get some help. Call the San Diego County Bar Association and ask for a legal clinic that can help you with your custody problem. They should be able to steer you in the right direction.

There are agencies that can help you get an attorney and fight for your child. Start by contacting the battered women's shelter in your area for services. They usually have all the information available to you, you just need to follow the steps to obtain it! Please take the time to do this.

You can also write a letter to the Judge explaining your situation, and he may be inclined to appoint you an attorney.

Please grind through the paperwork and get your child out of harms way!

In most states the laws provide that the court may award attorney fees. So, if that is the case where you live you might be able to get a lawyer to represent you.

There are some important details missing from your question:

-why didn't you take the child with you?
-how long were you gone?
-what is your living situation at this time?
-is there any report of your husband's abuse?
-if not, why not?
-was it verbal or physical?
-how is your daughter suffering from this?
-how old is the child?

It would not be reasonable to offer any suggestions to your question without first learning these details AND without firsthand knowledge of how custody decisions are rendered in your local jurisdiction.

seek for loose criminal counsel or borrow funds from kinfolk. save a log of each time you ex husband careworn you and record a retraining order if mandatory. the biggest issues working against you're leaving without your toddler, no longer having a place to stay and not being employed. you prefer criminal representation in the court. sturdy success.
