Would someone please tell me at what age child support stops in NewYork? Thanks.?

New York Domestic Relations Law Section 240
"Child support" shall mean a sum to be paid pursuant to court order or decree by either or both parents or pursuant to a valid agreement between the parties for care, maintenance and education of any unemancipated child under the age of TWENTY-ONE years.

Note: That does not state that the child must remain in school…only that the child must be unemancipated, which means that they still depend on the custodial parent for support.


I personally think that needs to be changed, but that's what it currently is in NY.

You can go online and look up NY child support laws or you can call your local child support enforcement office and they can tell you. Each state is different. Normally child support continues to age 18, marriage, child joins the armed forces or is legally emancipated. If 18 and still in high school, support continues to age 20 or graduation, whichever comes first. Any arrears you would still owe even though the child emancipates.

I live in New York and i believe that child support stops once the child turns 18 or it could be 21. Be sure to ask an attorney or local court house to make sure though . Good luck to you.

all states are different (slightly) with the age, but NY is 21, unless the child goes to college, then it can be extended.
