Mother went to prison, father makes barely min. wage. He has never been in trouble, doesnt drink, smoke, do drugs. He is fighting for custody in OK, but the mothers parents have money. Courts unfairly looks to them as best care givers. Money isnt everything. He loves his kids. This is hurting him alot. OK DHS is telling him he cannot win. This isnt fair. He is a great guy and his kids love him.

I feel very bad for this man. I am so sick of the courts thinking that all fathers are worthless. I would try to get the best lawyer that he can afford and fight them with everything he has got. Why would they look to these grandparents as being the best, look what kind of loser they brought up. Good luck!

There has to be more to this story. A court will not take custody away from a parent and award it someone else (even a relative) unless that parent is proven to be unfit in some manner. Being poor does not make a person unfit. WHY is DHS telling him he’s going to lose?

This is your family! I am shocked at our court system! You deserve to have your children!
So............. get your self a better paying job. But before you do that......... go to the legal aide office in your area. Ask for a state appointed attorney to help you file to get your kids back.
Do all you can to earn a better living and be persistent, consistent and scream the courts roof down. No one has a right to take children from the mother or father. Especially not grand parents.
I recon I get hot under the collar over this because my ex mother in law tried to take my kids!

Need a really good lawyer. I really can't understand why they wouldn't automatically send the kid to his dad to begin with. Why did the grandparents get the kid first? Point out that maybe this isn't the best place for his kid to be, they (grandparents) did raise a daughter and she is in prison!? He has every right to have his child. Good luck :)

Get a good lawyer, and try his *** off.

Or if the kids are over 12, they can decide for themselves who they want to live with. And chances are if one child is over 12 and decides they want to live with their father, the judge will declare it in the childrens best interest to stay together, and give them all to the father.

He can also request a child service agent to talk to the kids, and exam his and the grandparents home. (this does mean they will show up unannouced to surprise you and see what your home is like on a NORMAL bases) and then the child service agent can testify in court saying which home they think is best for the children to grow up in. (however, this could also work against him if they chose the grandparents).

Thats all I can think of, I think its crappy. If he was a woman he would of gotten the children hands down, even if he didnt have a job. I say he needs a really good lawyer.

Should not be a problem because they cannot deny parental custody unless they can prove him unfit in some way shape or form. If Mom is in jail Dad automatically would get custody unless there is more to the story????

never give up on the kids. get a good lawyer I would get one from a different town/city but close enough to work the case. and make sure they have dealt with kind of case before. if nothing else never stop trying and prove that to the grandparents.

He needs to hire an attorney who isn't afraid of the grandparents and will fight them head on.

He would have better odds with a jury than a judge, but may still lose.
