It depends how far the bank take it before refunding your charges. The usually time scales are:

1) Writing to the bank asking for a copy of your charges for the last 6 years using a "Subject Access Request" under the Data Protection Act - 40 Days to respond

2) First letter to the bank asking for your charges back - 14 days to respond

3) Letter Before Action, giving the bank one last chance to refund you before you take court action - 14 days to respond

4) File a Claim at the Small claims court - 5 days for claim to be served

5) Time for bank to respond to claim - 14 days from claim being served

6) If the bank respond, time to put in a defence - 14 days

So you will be going from step 2. Usually the bank ignore the first letter completely, and only make a response to the second.

Once the claim has been served by the small claims court, if the bank don't reply within 14 days you win by default, if they do respond they have 14 days to put in a defence. They don't usually do this, so again you win by default. If they do, they will back down just before the hearing is due, or not turn up to the hearing.

So the timescale is totally dependant on how the bank reacts. At the least its going to be 28 days, it usually take around 2 - 4 months.

depends on the bank - expect to have to wait approx 10 weeks then they will probably offer you 70 - 80% of the amount owed

about 4 weeks but you may find they will shut your account down or give you a very basic one with no debit card.
