Does anyone know what's involved in ending child support pmts in Ontario Canada? My ex-husband won custody of our only child (son) even though he was unemployed & unemployable by his own admission (due to a car accident) & not eligible for disability yet claimed to the Family courts that he would be renovating & selling houses to earn $. In fact, he has several under-the-table sources of income. When I told him our marriage was over & that I was leaving, he said if I didn't give him 75% of EVERYTHING, then he would go for my throat & make me pay. My son turns 18 this yr, won't graduate due to failed classes & not enough credits for his grade 12. He's with me every other w/end & I have a bachelor apt setup for those visits so he has privacy & a space to call his own in my house. I don't have a problem supporting my son but feel that once he turns 18 if he chooses to stay with his father even though I have made space for him here, I shouldn't have to pay anymore. It's been 5yrs.

NB; it's interesting how the courts decide custody these days-if you end up supporting your partner-they could end up w custody & support

Once your son turns 18 you are not liable for child support payments anymore unless there is a court order stipulating you must pay beyond age 18. This is not typical. Not finishing high school in a timely fashion is no legal reason to continue child support unless it has been ordered by the court.

You should not have been paying anything to begin with. Your the more stable of the two and the courts did your family an injustice by the outcome. Once he turns 18, its over. If you had years to deal with this I'd get more aggressive in court or leave Canada, but you don't have that much time left to pay so just try to make it work until your son turns 18. What his chooses are after that are his choices.

Val, yes, in all of Texas you can terminate your right as a parent. I agree that $300 is nothing in the form of child support, her is the math: $300 divided by 30 days this covers: Food - 3 meals a day clothing - at least one pair of shoes, underwear, clothes and other necessities. shelter - 30 days per month baby sitters and or school... All this at a cost to you of a mere $10 a day and you don't get up for the child when the child is scared or ill. You don't drive the child to the sitter or school (which means you don't share the gas cost). You have father a child out of wedlock and now that innocent child will have to always wonder why their father abandon him with a mother who the father thinks is "insane". Nice job. Did you ever think that the mother of your child needs the money on time because she has bills to raise your child. Step up to your responsibilities and pay YOUR CHILD Support. It sounds like that is the least you can do. Get a modification, go to court and let the courts garnish your wages; I think in your state the mother has to agree to the termination rights first. Even if she got a million dollars from the government or anywhere else has nothing to do with you or your responsibilities; nor does her relationships. I think if you tell a Family Law judge your justification including the one night stand part may increase your responsibilities just to teach you a lesson on reckless abandonment of your sperm. That is why condoms are free. You are a father whether you like it or not.

Child support is designed to ruin one or the other. Whoever gets the order to pay gets the shaft. I tae good care of my two girls who are 17 and 18, but I have been paying outrageous amounts of money to their mother for 15 years now. In the US it is a crime more severely punished then RAPE. Child molesters do less time in prisons than a child support offender. What is a non custodial parent to do when they take half of your income, taxes then takes around 1/4 of the rest leaving the parent to suffer. The laws need changed but it is not looking good right now. I feel for you indeed, and I hope everything works out for you and the kids.

I'm pretty sure that after the child turns 18, you don't have to pay child support anymore. If your son decides to live with his father, that's his deal... just put your ex out of your life after your son becomes an adult.

How did an unemployable man win custody? what kind of mother are you that could lose custody in a situation like that? wow. Pay the money for your child. Get over it.

call your lawyer...but up until he finishes school, you will be requred to continue payments and may even need to kick in more money for college/university up until a certain age. if he is not going to continue his education at 18, i would be telling him it is time to get your own place and get a job and support himself.......that is how you can get to stop having to pay support when he turns 18.....nice that you have a spot set up for him in your place, but at 18 if he chooses to stay at home and be it your place in his little bachelor pad, i would think it in your best interest to have him pay you rent and be out working. any way you need to talk to your lawyer for the very best and correct advice, as each case is different.....hope that this may have been some help to you though.

I absolutely agree but he is just selling wolf tickets don't by that no judge in his right mind will make you pay that bum. I would call his bluff and take him to court about it . Only after I record him trying to get over on me.
