The age of consent in all states of Australia is 16.
Several years ago it was changed to bring all states into sync. It used to be 16 for girls and 18 for boys unless the male was over 21 then the girl had to be over 18.
The only exception to the current rule is that if both are under 16, there must not be an age difference of 18months between the couple.
It is legal for a 38 y.o. to have sex with a 16y.o, but it is not acceptable in present day standards.

The legal age for a any girl in Aussie is 16, but given your an adult and she is by definition of the law a child, you may find yourself on the wrong side of the law.
Your old enough to be her father.
If you were the father of a 16 year old girl, how would you feel if she brought someone home who was 38?
My guess you'd want to rip his gonads off.
As a mother of a teen, I'd want to rip your gonads off, and shove them down your throat. Especially as your barely a few years younger than me.
Go fine a woman of your own age, and leave the girl to finish her schooling.

As many have brought out, the age of consent is 16 years of age...so, yes, it is legal.
However, as you are the adult...and she is still a minor...you'll have to be the one with some sense.
Make sure she is ready, and you aren't taking advantage of her...
If you both love each other, you'll wait; moreover, a lot of people want to jump into bed without thinking about the consequences...(i.e. possibilities of a baby coming into the world).
Men and women (mostly men) tend not to think clearly when they're horny, but be sure that you're ready...(and, again, be sure the girl is ready).

The age of consent is 16 but it includes carnal knowledge, which does not include sodomy (anal sex). Sodomy is legal after one has attained the age of 18.
Anyways, think about the age difference. Do it only if you both really wanna do it!!

oh dear thats never a good idea. that girl thinks shes grown up but she is not! she isn't who you think she is, she isn't who she thinks she is. if you love her then you will wait till she is older. if you don't than back away slowly.. then run. have you ever heard of the bar rule? if she can't get in to a baar, NO DEAL! good luck do the right adult thing and let her grow up first. please.
