Do you have a home-owner's association? The local building code enforcement officer can be called if not. Or sue them is a civil court, the other actions are free.

Have you spoken to the neighbour? That should be the first course of action. If he/she is agreeable to re-routing the drainage, then problem solved.

If they refuse, then other legal actions can be taken. And he/she would definitely be liable for any damages to your property.

If it is a waste water drain such as a sink, dishwasher, ect. you should contact your city (or county) Dept. of Health because that is a code violation and they have to move it and/or pay a fine.
