Yes there should be a pay shift differential. It is an incentive for employees to work such hours. 2nd shift is really hard with people who have school-age children, as it does not allow the employee to see them until a day off. 3rd shifts messes with the body's natural sleep pattern and many times sleep aides are needed. In addition, both shifts may require the employee extra expenses for daycare if they have children. The pay should be based on a percentage of the employees base pay or a flat rate across the board. Usually 3rd is slightly higher than 2nd shift. A flat rate would actually be a better morale booster. Where I work at, shift diff. varies between personnel in the hospital. 2nd shift ranges from $.25-2.5 and 3rd $.50-4.5. We also get a weekend differential as well.

Yes i work 12hr shifts from 7pm till 7am and make a 12%differential

Yes. And there usually IS one: it's called a shift differential.

The pay increase varies the later you work.
Some employers will try not to pay this. Unfortunately, I don't think it's illegal.
