Five years prison at the very least, and that's for the first offense. If he's a repeat offender, he should get 20 years to life.
First offense in Texas is a 3rd degree felony---2-10 years and fine of $10,000.

Guess that answer depends on who you are asking? A victim of a drunk driver would tell you LIFE is not LONG enough!! A wife or mother of an alcoholic might tell you far less time because they want their loved one to get the help they need. Personally it should be enough time to let them think about their irresponsible actions but sadly, that does not always happen either. Either way if he did the crime he's gotta do the time and that will be up to the courts but in the meantime, you and your children should not be riding in a car driven by him if he has been drinking

Sounds like there are more victims than in just the accident. It's up to the Court to decide that, and many other factors will be considered such as first offense, severity of the accident victim, blood/alcohol levels, etc. Right now I'm thinking about the victim and your kids, they are the ones paying. And of course...yourself. Best you get through this and put it behind you. Fortunately no body was killed! Peace.

It varies by state, county, district, nature of the offense, how bad he hurt the person, how many times he has been caught drinking and driving....
Get a good lawyer.
If I were on the jury i'd hang him. He should know better.
