The legal definition would be someone who lacks the capacity to distinguish between right and wrong.

It's usually reserved for people suffering from a severe mental illness, such as schizophrenia, where their capacity to distinguish between reality and fantasy has been severely diminished, as well as their ability to understand the consequences of their actions... both are legal requirements for establishing guilt.

Other forms of mental illness might not meet these requirements. A sociopath wouldn't, for example, since they still have the ability to distinguish between right and wrong.
