I gotta tell you, at first glance this post makes you seem like nothing but a greedy gold-digger who wants a piece of what her ex now has, and the added-on statement that you don't want the money but are doing this for your mentally-disabled child sounds like a load of crap. I must ask, because you failed to mention it: is your ex the father of this child?

Check the local laws in your area and see what they say about having the settlement adjusted, but you'd better be prepared for one hell of a fight. If I were your ex and you came into court and said you wanted more money because my "paycheck has doubled, and oh, by the way, I need it to support my mentally handicapped child," I'd make damned sure that the money never went directly into your hands. I'd set up a trust fund and appoint an attorney to handle it. Whatever it would take, I'd ensure that you never got your hands on a dime of it.

And if the child wasn't mine, you'd never see a cent.

If your reasons and motivation for seeking more money from your ex truly are to care for your handicapped child, I wish you all the luck in the world and hope you succeed.

But if this is just a line of bull so you can get your hands on something he has that you want, I hope when you go to court you get pounded into the ground like a tent stake.

You can go back to court to get an adjustment ,You will need a lawyer to file a motion, and also depends where the support order was placed .if the order is in florida you do it there if it is somewhere else you need to file a motion in that state ......good luck

Well I definitely think you should check with your lawyer. If his means improve ie he gets more money and therefor has a better mode of living and you are still only getting the same old check amount i think you might be able to get more money from him either as child support or spousal support. Either way do a free consulation with a family lawyer and check it out. Good Luck!
