Bill is right; you need an attorney. Try calling a legal aid office to see if they will represent you for free (typically, they do not represent men in these matters, but parental kidnapping makes a strong case for you). Even if you cannot get an attorney, you can go to court on your own. Explain your situation and hopefully the clerk will tell you what you need to file. That way you can open the case against your wife while you try to find a lawyer. Hope that helps. Obviously none of this is legal advice. Your lawyer can help you out with the details of how to handle your situation.

Since you're in Florida and she's in California, you'll need a lawyer that has jurisdiction in that state. Most lawyers charge nothing for a consultation - which should be your first avenue of approach. Even with money being the issue, there are certain law firms that will take cases of hardship on a "pro bono" basis. As long as you have been a good father/husband (i.e., no abuse towards the wife or endangering the kids), you stand a GOOD chance of getting your kids back to you. Good luck.

Contact the authorities here. If you can convince the authorities she took off with the kids to avoid divorce and custody charges with charges pending here, she will be charged with parentalkidnapping, a Federal offense. Just give them what information you have and dont make up anything. She can run but she cant hide for long especially with kids. Once found she ll be arrested and the kids returned to you. Also she cant threaten you with anything and besides tell her to go to court, thats exactly what you want her to do but then the authorities have her, big mistake on her part. She will automatically lose the kids. Right now everything is in your favor legally but now its time to find her and let her dace the courts for her actions. The law is on your side here so you have nothing to worry about. Good luck

When you say soon to be ex wife. I asume you are going through the divorce. Each county/state. Has legal aid.Got mine for free. If you know she has a warrent. Call the police. But being you are not divorced yet. She can take the children.
Im going through just that. But I have the children. It was a domestic abuse deal. And he got him self a lawyer. Wants to see the kids after he beat on us. I went to the court .Started a divorce and the leagal fee are wavied if you show that you cant pay.If you have that phone number.Give it to the police.
And tell them she has an active warrent. Then they can arrest her. Send calif officers and track down where she lives. There are alot of free help centers out there. Just ask the court and tell them of your problem. But remember. If you are still married. She can take the kids across the state line. Becouse she is the legal mother. I had to go through the victim witness program. Just to keep my kids safe. So he would not go to the school. I dont know of his wearabouts. But with that order.(restraint) It would then be a crime for her to take them.Your best bet now is that warrent. It shows she is running from someone or something. And it puts the kids at risk.Go to your local court. And demand to get help. Its your right. I live in calif.Any help at tracking down the town. I will help you.
Im going through this now and I know what a burden it can be.
My name is gina. You can contact me at osbournefanoz@yahoo.com. If all else fails . Go public. Local news and or paper. She can run but not hide. Good luck to you!

Call the police where you live. You may be able to get the FBI involved. Kidnapping kids and taking them across state lines is a Federal offense.
Also, she is trying to blackmail you. Bottom line, you need to get in touch with the police immediately. The sooner the better because the trail will get cold soon.

First call her and demand to speak to the kids. Make sure to tell them you love them and that you're scared too and you miss them. Then call the relatives she contacted and see if you can see your kids (make sure you remind them that you /are/ their father). If that doesnt work call the police in Florida and give them the number, her name, and the name of the relatives she contacted. They have better resources for finding people than you do! Do not leave you fiance, that will just give in to you crazy wife's demands.

She can't have your parental rights taken away. You have to sign your rights away unless she can prove that you have abused her AND the children. Rather than get a lawyer if she took the children to California without permission you might want to call the police.

everyone's right about getting a lawyer but if you don't have full custody of the kids I don't see how she kidnapped them if I were you I'd go about getting custody first I believe you can file all that where your from then once that is granted you can file charges against her for kidnappping. My ex husband took off with our daughter before and even though he was drunk and on drugs they couldn't file kidnapping on him because he was on her birth certificate which meant we shared custody but now I have full custody and I dare him to be stupid again.
