One of my friends is trying to get a divorce and he doesn't know where is spouse is living and she refuses to sign divorce papers and agree to the divorce. Is there anyway for him to get a divorce without her signature or approval?

I'm not the one who won't sign the papers. He is my ex fiance and we want to be together again since his marriage didn't work but she is being difficult about it. If someone didn't want to be married to me any longer I would gladly sign papers. I won't be with someone despite them. Thats just stupid.

Yep, sure is... even though he doesn't know where she lives, by law an attorney he goes to has to go by her last known address or state she lives in and put it in the paper for atleast 30 days. If she doesn't respond then by law, the court will grant him a divorce from her.If she is found, then she has 30 days to appeal and get an attorney, if she fails to get an attorney or show up to court, the court will still grant the divorce. There isn't much she can do about it.

Yes, in most States once he signs the papers they file with the newspapers in the general area of the other spouse and wait for a specific time, like thirty days, then the divorce is finalized.
If there are relatives they are notified as to where the person is, a general search is put out but, not really followed. This is a trick some use thinking they won't get a divorce if they don't sign the papers but, they're wrong.

Patience Wins this battle. The judge you go before if you have made every attemt to get the papers signed will take the papers after a while and grant the the big D.

Where he live? Each state has its own rules... but in general...
He must make a 'motion' to the local court, and support his motion by His Affidavit and Your Affidavit saying to Judge the same that don't have her address and she would sign and what kind of woman she was ...then judge would tell what to do....

Yep, just go to the county clerk's office and they can steer him in the right direction. Why hold up the life of someone who doesn't want to be with you anyway? Let him go.

Makes no difference..
He does not have to know where she is, she does not have
to agree or sign anything...
Have him call the clerk of court and ask for the proper procedure....

Yes but I don't know how. It only takes one person. Somebody else posted about putting it in the newspaper and if she doesn't contest then it's official.
