If Bush is claiming executive privialage to keep the people from testifying to congress in a criminal matter, is this not obstruction of justice?

That wont stop Congress if they use investigative oversight committees and prove there is a problem. Richard Nixon wasn't above the law like he thought he was, Bush is no different. They have to open an investigation like the Neocons did with Clinton, remember Kenneth Star don't you?

One would have to be charged with a crime for there to be a criminal matter.
