we live in my husbands mothers apartment building. Hubby and i had a big blowout and constantly fight. He now has told me i have to "get out" in 30 days. We never signed a lease because his mother owns the place. i have proof of over 2 years residency there and young children. i have proof the rent comes out of my checkbook every month. what are my options here. i don't make trouble and pay rent. with no lease can he/his mother kick kids and I out? do i have more than 30 days notice here? HELP I live in Wisconsin.

If mother wants you out you must leave, but now your husband is responsible for your rent in the future.

Hopefully he can pay it.

This is the part where you hire a lawyer and let the lawyer get your hubby and his mommie for you.

Mom will likely kick both of you out, and your lawyer will find a way to make hubby have to pay your rent and child support if the two of you have kids together. Your lawyer may also find a way to make mommie wish you and hubby were back together.

So much for big blowouts.

What do you want to do? Stay even though he doesnt want you there? Do you want him to leave and you stay even though his mom owns the place? Or do you want more time to find a place?
If hes giving you the boot, he needs to give you money to move.
It doesnt matter who's checkbook the rent came from, you are married. the money, the assets, all joint.
Since his mom owns the places, chances are you'll have to leave, and he has given you the appropriate notice. usually 30 days is all the notice required to be given.
Im so sorry to hear you are going through so much and that he would just kick you and the kids out. If you have friends or family, go stay with them if you can until you can get your own place. I wouldnt want to stay in an apartment my ex's mom owns anyway.

they probably have to give you written notice to get out. I would call the sheriff and ask what the normal procedure for eviction is. Then get a lawyer and get some child support for those children. I don't think he can kick you out if he is not the owner or manager his mother must do it. i think some states it is 30 days some it is 60 days notice.

Well, this one comes out to be "He said - She said" thing. Since your mother-in-law own the place, she's got the right to do whatever she wants to. If things came to be very bad, she might even sue you for living illegally in the house. Chances are, she will be siding with your husband, since they're blood related.

Best thing to do is consult a lawyer and find out about this before it gets to be even more difficult than it is already.

No, he can't just kick you out! Research the sites below. Make sure to change the location/state in which you reside. Hope this helps.

Your husband is in no position to kick you out. If his mother wants to kick you out, she has to follow appropriate procedure for your area.

Yes, absolutely. Infact, they are being nice by giving you 30 days notice. Normally, in a Tenancy At Will (which is what you are doing), either party can terminate immediately with NO NOTICE to the other.

It sounds to me you have the right to stay there. Unfortunately, I think it is time to get a lawyer. The lawyer will treat you like a pinyata filled with money, but thats life I guess.
