does it exist in ohio and what if the person was separated but married to someone else the whole time you were living together?

You can not be married to two people in Ohio at ANY time. even if you are seperated from one. IF the party had not been previously married then yes, Ohio does recognize common law marriages IF they were formed before 1991.

The concept of a common law marriage describes two people living together WITHOUT benefit of marriage. That means you do not get any specific benefits, and it is not considered bigamy if you are already legally married. It may be adultery, depending on the state.
