Talk to a lawyer in your state. Contrary to the first answer, I am in Mississippi and common law marriage does not exist here.
Here, if you owned any property jointly - joint with rights of survivorship - it would be yours if he died, and if you wanted to break up and were fighting over who got to keep it, the court would still decide just like in a divorce. BUT, if everything is in his name, and you are not married, no matter how long you've been together, you would quite literally be a** out if he died. If he had any living family, they would have rights to it, not you.
So don't go on anything you get here, unless it comes from a lawyer in your state.

Totally depends on what state you live in. Some states don't recognize "common-law" marriages. It's a good idea to look into your state laws on that subject....just in case.

States will vary, but in TX its common law marriage and your entitled to "half", just as if you were legally married,,,,,,,,,,(by the way in TX you have to be living together for a mininum of 6 months),,,,,,,,,,
