A couple in N.C. got married and the deed for the home is in both their names. He walked out and she says that she gets the house and he has to pay the mortgage. At the house, there are children that are of his wifes previous marriage. Does he pay the mortgage and what else are the Laws concerning this matter in North Carolina..

Did he adopt her previous kids as his own? If so then she will be awarded custody of the kids along with the house unless she refuses or is ruled unfit as a mother. If he didnt adopt them, decision could go either way depending on whether the judge feels sorry for the kids. He may let them stay temporary until they find some other place to live. Without the kids, the judge could order the house sold and the proceeds divided after debts paid. There are alot of scenarios here, but most comes down to what the judge feels here with the kids. Wish I could give you a more decisive answer but the courts dont always go the way we learned in college.
