Shouldn't the teachers, social workers, and or physician/pharmicist be facing the same charges? Each of them saw a problem, and neglected to adequately act upon it. If they had, little Rebecca would probably still be alive right now.

I'm sorry, I don't see how all of them can seem to justify their non-response in any way.....this was a 4 year old little girl with her whole life ahead of her!!!!

I suppose this is one article that got to me, cause I'm sitting here crying my heart out knowing that that little girl didn't get the chance to live.

However, as a nation, I can't help but wonder if we do enough to protect children under circumstances such as these. If they were all seeing a problem, why didn't she get help?

I just don't understand......

I wanted to point something out to the first poster.....

While they weren't DIRECT accomplices, they could still be guilty of accessory to the crime, since their actions (or in this case, inactions) resulted in the death of a child.

There is a direct correlation between actions and results here, don't you think?

"Interviews and a review of court documents by The Associated Press make it clear that many of those who were supposed to protect Rebecca — teachers, social workers, other professionals — suspected something was wrong, but never went quite far enough."

Most of these people are "mandatory reporters," that is, they have to report to either superiors or a child protection agency when they see things that could constitute signs of child abuse. While they shouldn't be charged with murder, or even conspiracy or accessory to murder (since they really didn't have the mental state to actively encourage, or be complicit in a plan) prosecutors should look to prosecute them under the state's mandatory reporter law.

The teachers, social workers, dr., ect. cant be charged for a crime because they didnt do anything. You cant be charged for murder for an omission (not taking the child away from her parents). As tragic as this case is, not doing something is not grounds for a murder charge, or even negligent homicide.

They are also not liable in civil court, according to DeShaney v. Winnebago County. Of course we should feel terrible as human beings and pray for the child, but what good would come out of a claim against the state? The result would be more children taken away from their parents and placed in social services. Some of these children would have been better off with their parents, and none would be well off in social services.

This is a terrible case, but the people at fault are the parents. May God have mercy on them.

They cannot legally do anything except suggest to the parents that she should go to the doctor unless they have some sort of proof. They have been punished enough knowing that a little innocent girl died and they might have been able to stop it. Her parents deserve to rot.

That is too sad..i would kick the doctor in the throat. What is he doing diagnosing a four your old ADHD..and uping her medication in the first place. RIP the pain is over now.
