I live in Indiana,on3-1-07 left work and went to the hospital thinking I was having a heart attack.I spent 9 days in the hospital,-heart attack was pulminary embelisms and they did a byopsy and found I have hotchkins lymphoma-cancer.I have not been released to go back to work yet, and I start chemo this monday.my human resorce director called me this past tuesday saying she needs all my medical records and my restrictions to decide if they are going to keep me on or terminate me because I havent returned to work yet.I called my doctor and ahad a letter sent to her.I am going to get a lawyer to deal with this.I did not need this extra stress and wanted others input on this situation.(please only serious answers) thanks for your time.

No, they cannot fire you for getting cancer, but they can fire you if you miss too much work. I realize that this is a real technicality, but that's how it works. Chances are, they will give you a long-term or short-term medical leave for this current period that you were away. If they don't offer it, ask for it. And for any future times that you will be off work for this. You don't get paid for this time off, but it protects your job. They just need to verify and confirm your time away for their records. It doesn't sound like they intend on firing you this time, but if you continue to miss time without requesting sick leave or medical leave, they will have no choice but to let you go. You need to work with them to try to figure out how you can arrange your time off and still keep your job. Most companies should be willing to work with you if you talk with them about it. If they can plan for it, they're okay with things. It's when they get left high and dry with no explanation that they start getting upset.

If you work for a government body, you won't have a problem, however if your employer is a smaller concern, they need to have all the necessary paperwork in place so that they are not compromised by you being off work.
Keep contact with your workplace H.R.D. and give them updates on your progress.
Your workplace must keep their "Show on the road" so-as-to-speak, so don't let it get you down.
As you would be aware, you don't know if you will be able to do the work that you were assigned to do in the past.
In fact, you may not even want the job when your treatment is completed. This is a one step at a time situation that both you and your employer can't predict. Take good care of yourself, and have a speedy recovery.

NO THEY HAVE NO RIGHT! ITS AGAINST EVERYTHING!!
THEY MAY GIVE YOU A DEMOTION BUT TO TRY TO MAKE YOU QUIT! BUT THAT IS HORRIBLE. GOOD LUCK..GOD BLESS..TAKE THERE BUTTS TO COURT!

under the family and medical emergency act they can not legally do this. please contact someone as to sue the living crap out of them.
