My husband and I were involved in an altercation the police were called. I was arrested for throwing a pillow. Later on a judge in a court of law convicted me of throwing a pillow. I was sentenced to 2 years probabation and a domestic violence course. Do I have a criminal record?

Also the plea was facts sufficient. I don't think I was convicted. Conviction was contigent on me not finishing a program that I finished

Yes . You are a crim. You will stay a crim for a few years until the conviction is deemed "spent".


* most convictions become spent after five years
* prison sentences up to six months become spent after seven years
* prison sentences up to two and a half years become spent after 10 years
* sentences over 2.5 years are never spent
* rehabilitation periods are halved if you were under 18 when convicted.

Yes, you have a criminal record. Two more times of being convicted of throwing a pillow may land you in a prison, so watch the temper!

I realise that you used the word 'status' in your question in innocence...but boy what a word to choose...to think that a criminal has status in society ...a bit like a badge of honour!

As to you question ...yes you do have a criminal record the fact you received a 2 year probation order is testament to that.

Not complying with the DV course, would be another trip to court for breach of the order!

If as you say you were convicted and sentenced then yes you have a criminal record.

yes you do for domestic voilence you need family counciling and should seek it
that is what probation means, a convicted criminal
be good and don't get in more trouble

Yes you do have a criminal record. Because it was your first offense, you didn't go to jail or incur a more serious fine/probation/punishment/etc.
