It's illegal to forge a signature, but no one really enforces the rules when you're depositing money (unlesss you're trying to get money in your account that isn't yours). I'm assuming your wife/partner forged your endorsement on a check and deposited it into your joint account. Technically that's illegal, but your options may be limited unless you want to file charges (in which case your attorney fees might outweigh any recovery; not to mention your relationship would be ruined).

The real crime would be forging someone's name to withdraw money. But it sounds like your significant other simply took money out of the joint account. That's completely legal, even if he/she got the money in there without your knowledge.

Talk to your bank manager either way and let them know what happened--if nothing else so it doesn't happen again. Banks are pretty lax on signature stuff with joint accounts unless they know there's a potential issue.

Do I understand the question? You have a joint account with someone. That person forged your signature, deposited a cheque into your joint account and then withdrew the money?

If I have that right, then the illegal parts are that
a) he forged your signature and;
b)did so for the purpose of taking money that was not his.

But I think the question you should be asking yourself is "Why do I have a joint account with someone who would forge my signature and steal my money?"

Let me get this straight, the check was made out to you and someone else signed your name so they could deposit the check into your account and then drew the same amount of money out of your account.

If this is what happened? Yes it's illegal. First of all they forged your name twice once for the deposit and again to make a withdraw, and third they stole your money.

I would file a police report A.S.A.P. and also question your bank about how this happened. Why did they not ask for positive I.D.?

what you should have done was set up the account so both parties need to be present to make a withdraw, the account should also have been set up so that any time a change in account status is made you would be sent an alert from the bank. yes it is illegal , file a police report, give the bank a copy of your signature to keep on file as well as a copy of the police report so that you get re-imbursed and then kick that person to the curb for trying to screw you over.

yes this is illegal, if you have this problem bring it to the attention of your bank and they will help you with the process of pressing charges on the person who is forgeing your name.

No. Not if the check is made out to you and your signature was forged.

**Edit**

Sorry...I read that wrong...it is not legal. It is illegal.

Anyone can deposit money into your account, as long as they have th account number.

However, no one can make withdrawals from your account without proper ID.
