...but prostitution is not?

I'm not looking for any social commentary on the evils of either, or whether the laws should be changed. I just want to hear arguments as to WHY one is legal and the other isn't. They seem the same to me, except one is in private while the other is being taped.

Thoughts?

It's freedom of the press that protects it.

To those who talk about taxation -- if it were legal, it would be taxed.

I guess prostitution's illegality is a holdover from our "Puritanical" past.

People feel it's wrong, and there isn't enough pressure to legalize it. (It's illegality is wrong, it seems to me.) There IS a group that's advocating de-criminalization, but they just don't have wide enough support.

BTW, it IS legal in Nevada.

And, no doubt, taxed. It's also controlled there, making it a much safer thing for all involved. Condoms are required, the "workers" are checked for STDs, and they aren't in danger from customers gone bad.

Ironically, it IS the public nature of porn that makes it legal -- as freedom of the press (or public speech).

Finally, an intelligent question on yahoo answers. In my opinion, I imagine pornography is legal for several reasons. First, it's a multi-billion dollar industry, which means lots of money to spend on lobbyists to keep it legal. I also imagine it's legal because, it is a regulated industry. All of those media companies are legitimate businesses with licences, pay taxes and follow state/federal guidelines. Lastly, I imagine it's legal becuase it is protected under the constitution under freedom of speech and expression, or freedom of the press if you include books and magazines.

As for why prostitution is illegal; well it certainly isn't regulated legally, and one couldn't intelligently argue it falls under freedom of speech/expression (since it isn't on film). Not too mention that the government doesn't see any of the money made by prostitution. I guess another reason is not all prostitues are consenting adults over the age of 18, but that's just a guess.

I think it should be legal, but that's just me. Not only is it an untapped resource of millions of dollars for financially strapped state and local governments, what a woman (or man) does with thier body is thier right. If your going to f**k someone you don't know why not get paid for it.

Some forms of prostitution are legal in these United States. For example, my Congressman gets paid and he's been a whore for the whole time he's been in office.

Probably because prostitution was more in people's faces via whore houses and street corner hookers, which pornography is usually more private.

Government can't make money off prostitution. If they can't tax it, it's illegal.
