Neither of these two cars is good for a first car. You need a dependable car that will not fail you at any time, and if it does it should not cost an arm and a leg to fix it.
Both of these cars will break down at some point and will cost you a fortune to fix. But all young kids do the same mistakes and then 2 years later you will be selling this car for half of what you paid for and looking to finance another car.
Anyway, in my opinion get yourself a 2001-2002 Honda Accord or Civic, or perhaps Toyota Corolla or Camry or maybe even new Honda Fit, and enjoy. Any of those cars will give you no problems.
You need a dependable car, don't try to get a car to attract chicks, you should be able to do it without a "cool" car.
I know you will not like this advice, but you will remember me 3-5 years from now and see I was right.

The sentence "I would not touch it with a 40-foot pole" springs to mind when someone suggests an ML. Don't. They are the worst vehicle to wear the MB star. Ever. This is even more true of some of the older models, the phrases "shoddy construction" and "poor design" have been used.

As far as the Beemer is concerned, they have been rated as "Avoid Like the Plague" as they are just old enough to start costing really serious money. The review goes on to mention a "perennial market of suckers" etc etc. If it is a seriously low miler, like 50,000 miles/80,000km it might be worth it for a couple of years. But the speedo readings are easily and commonly faked on these models, apparently among the easiest in the world.

If there is a full service record, more or less up to date which actually comes with the car and evidence that the timing chain has recently been replaced then maybe consider it . These cars are lightly built like some Asian vehicles and have a very poor safety record.

Wow, you are lucky!
The Merc is probably the better car (honestly bmws really aren't that good).
In all thruthfulness, the BMW is a bad *** looking car, but the Merc would probably be more dependable.
Because I don't know what you would prefer, I can't really help you.
Personally, I would go with the 323i though, what a gorgeous car.

Lemme see......Mailwagon or cool sedan..........

Depends on your needs, but for a first car, the BMW seems more sensible. These are both fine vehicles but be careful...those maintenance costs will eat you alive, they are both expensive to repair.

Reliability - Mercedes
Fuel Economy - BMW
Cool Factor - BMW!!!
