i own a shop,and you can sue them ,but its a long process,and the will probably win,the reason they,ll win there mechanics word will stand out over yours,i have seen this happen before with dealer ships,there really isn't no winning with them,what id do if i was you is find someone else to do the work on it as long as its under warranty,any dealer can do it as long as its a Hyundai dealer,the one you have now sound like a bunch of crooks,to me there are others around who will appreciate the service work,good luck hope this helps.

if the garage is saying that the noise is caused by a bent stub axle, or hub assembly in the case of FWD, in my opinion they are taking you for a mug! HOW could they grind the discs on the car if their contention that run out is the cause of the noise, caused by this bent part due to the vehicle being curbed! contact the institute of Diagnostic Engineers and ask for local listing to your area, of their members MIDiag.E and FIDiag.E whos field of expertese is automotive engineering.
Instruct them to examin your vehicle and to prepare a report, write to the garage outlining your complaint stating that a copy of the engineers report is available on payment of the fee [you must offer this report but you can charge for providing it] (send by RD) If ignored start county court action, if they contest it, the court will order both parties agree on a joint expert witness i:e FIDiag.E, to exclude conflicting evidence, under these circumstances the judge is highly unlikly to allow a garage fitter to give an opinion in court, and would be obliged to accept the joint report from the person with the highest qualifications, as ordered by the court.
No one in business can afford adverse publicity gained by a court appearance for devious or sharp practice irrespective of their fiancial capacity. these business rely on the fact most people will not persue their claims because they cant be bothered, an or it is too much trouble.

In all fairness the car is three years old and has covered 45k miles. So it could be down to wear and tear and bumping kerbs.
I doubt you would get anywhere pursuing it and it will probably cost more than the repair to try and do so anyway.

Get onto hyudai customer care and explain the problem to them. They should do somehting.
To bend the shaft you would have to hit the kerb at great speed leaving damage to the wheel and tyre.

why do you want to sue?? because your car needs a repair and the garage say your to blame and the warranty isnt paying!
if it was a fault with the car surely it would have been there from the day you got it!
best of luck, getting it for free as it sounds like wear and tear.
