What questions should be asked at a child support hearing in order to get the best results?

My friend has a child support hearing coming up. She wants to know what should be said in order for her to get what her child deserves. (The man has been giving false information in order to get out of paying child support) Please help.

Documentation is huge. Photos of his new car, or new stuff should help. If he has a myspace type site... snag photos that ensure that the site is his and then print out his blog that describes what he does with his free time.

If he employed by a company then he can't really lie about it because he is required to provide all of his salary information as well as his most recent W2 which he probably only got in January.

If he's self-employed or works under the table that can be a trickier thing to nail down and as I said the more documentation the better.

Also check out how his expenses weigh in against what he's claiming to make and toss that in with any new things he's bought recently.

if the dept of revenue goes to court with her they will fight for her to make sure she gets what she deserves. if the guy is getting paid under the table to hide his earnigs tell the enforcement division of dor department of revenue. they will swap the guys mouth for dna. if the states taking him to court on her behalf they have all his earnings on computer. you have to establish he is the father with the swap before she gets her money. if he works a regular job he will pay for 18 years longer if the child goes to college good luck

there are NO best answers to help her case (from his false answers...which are common).

there are ONLY KNOWING THE LAWS that will help. give her ALL of the info below.. .and tell her to learn all of her states laws/federal laws about child support. TELL HER TO LEARN THEM ALL: its her best armor.

if the court date is for arrears, and her caseworker (or dept) hasnt been on the ball, pull rank on 'em and apply some heat to the case.


1) call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?
--why has there not been a lein put on his bank account?
--why dont they take his drivers license?

2) sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, and the problem and ask them what they are doing about it. tell them you respectfully request that all state and federal child support laws be applied to this case.

keep the letter short, its more effective.

then take that ONE letter and FAX it to the following:
a) your states Attorney General (link is below)
b) your states Governor (link is below)
c) your states Regional FEDERAL Child Support Office (link is below)

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean.

WHO CARES IF YA MIFF 'EM OFF, just keep at em weekly until they address this problem and apply all state/federal laws to your case. from that point forward, they will know you know how to pull rank and will be all over him

3) report his azz to the IRS, his employers also.
