America is so hypocritical when it comes to Guantanamo there are people in there that haven't been charged with anything so how can they say they are terrorists if they are put them on trial and prove it.And Freakzil last time I looked AUSTRALIANS were entitled to constitutional rights and you have had one in there for 5yrs and we are supposed to be your allies.Lock some of your traitors in there and also the soldiers that raped and killed a 14yr old child.At least when the Iranians caught British in their waters they followed the Geneva convention the same cant be said for the land of the brave and free.

You know, I wonder whether the founding fathers believed that all people deserve the same rights, or just all Americans.
I happen to believe what they said in the Declaration: that we're all created equal. Therefore, we are all entitled to the same rights - including those guaranteed to Americans by our Constitution. The founders were building a nation. They could only control the laws as they pertained to citizens of that nation. The Constitution is meant to lay out not only the framework for the laws that govern this country, but a standard of behavior by Americans. Therefore, I think it is in the spirit of America that we practice what we preach. We tell the Iraqis: "Try freedom. You'll like it." But we refuse to follow our own judicial practices when it comes to our prisoners of war. Let's not forget - we are supposed to believe that all people are innocent until proven guilty. Many of the prisoners at Guantanamo haven't even been charged with anything. They're just being detained without explanation.
If they've committed crimes, then they should be punished accordingly. But detention without benefit of formal charges is not an acceptable form of punishment for crimes which haven't even been claimed, much less prosecuted.

maybe we should give constitutional rights to people who don't live under the constitution, that way they get all the protection, without any of the rules.
How can I not live under the constitution? That would be a great life. No rules!!!

Of course, because most of them are not guilty and a regular court would see this....
Gitmo is the worst mistake in American history... the brave fight against terrorism became a unlawful, barbaric action in the eyes of most human beings because of Gitmo... the reputation of the US has never been worse than now... if we are really the country of freedom and christianity we should overcome our fear and act as that what the US are... the motherland of freedom, democracy and human rights
