He is receiving disability payments. His brother is power of Attorney over him and has put him in a nursing home. Is a minor child thats seven years old entitled to a percentage of the SSI benefits his Father receives. If so how can I make his brother pay back all he took in back pay of the SSI benefits my Ex has already received?

Diamondb answer was total horse shi*t.....take care of the kids by themself? why should 1 parent only have to support? nursing home or no nursing home....that father should be the one to make sure his child get whats coming to him......If fathers would take care of thier business on thier own.....women wouldnt have to be ball crushers in court.

My son receives dependent benefits every month from his father's SSD and I also have support enforcement attach HIS checks each month, too. I am owed 30,000 in back support and received nothing for over 8 years. Now that they know where he is I make sure my son gets every penny he's entitled to. DO NOT FEEL GUILTY ABOUT PROVIDING FOR YOUR CHILD JUST BECAUSE THE FATHER IS DISABLED. Shame on the people who tell you to feel sorry for him because he's in a nursing home. He made a baby and that child needs food and shelter. Good luck.

Yes, the child is entitle to the father's income. No matter what the income is and from, the child is still entitle. What you need to do is file a petition for child support and when you go to court let them know he receiving this income and of course he will have to show proof as well. If you already have a court oreder for him to pay and he hasn't then you may be entitle to the back arrears if not then he may only be entitle from when the order starts.... Good Luck!!!!!!!

I believe that your daughter is entitled to some SSI compensation as well. However, contact your case worker and ask them to assist you in obtaining child support payments. Give them the details, they too can help you with the paperwork in filing for ssi benefits for your child. Good luck!

if hes in a nursing home then all of the money goes to them. And any extras he needs his brother has probably put in a aalowance account for him. You women should really learn how to take of your kids on your own. You cant' touch ssi. If I could take care of my son when i was 16 years old by holding on to two jobs so can you. All we see in this world nowadays is money.

Your child qualifies for SS payments because his father is disabled. You get more money that way, than you do from a percentage of his. Call the SS administration to apply for benefits for your son.
They may even back date the support to when he became disabled. That's what they did when my friends sister became disabled. It took her 2 years to get her benefits, but they paid her from the date she became disabled and paid the dependent care from that date as well. She ended up getting a lump sum of $25,000.00 for her and her children, and then it started coming monthly.

Talk to a lawyer about the benefits that your daughter has, cause I believe that she can receive some SS benefits because of him.

Ok I feel really bad cause I can't remember the number but just listen for it on the radio it will be a kid saying the add just call the number.

get legal advice, or in UK contact the CSA, go back to court , but first write to the brother asking him for payments saying that if you don't get anything then you will get legal advice which if it goes to court then it may end up costing him more in the long run
