Hi I'm back. I have a 8 year old daughter and she has a lot of problems and we have signed her up for a check many years ago,the ss keeps on turning her down. So we went and got ourselves a laywer and he says that he might be able to get her on a check because of her schooling. She has failed kindergarden twice and now she is on ADD medicine.Does anyone think we have a chance on getting her one a check? Please I need some help on this.

Getting turned dow for SSI for your daughter may not have been detremined by her disability, but by your household income. If your household income is over a certain amount (size of family helps determine the cut off point) you almost certainly will be turned down. Add in that children with developmental disabilities (such as autism), emotional and/or learning disabilities have a higher rate of claims rejection than children with serious health issues. Before you agree to anything with this lawyer, have him explain all the facts in the process, including the income guidelines. Also, before resorting to an attorney, go to the Social Security website, download the forms and check list and then scheduel an appointment with the nearest office to try to process again. It may end up that your daughter does qualify now and you will save yourself the cost of an attorney. If she doesn't qualify, you'll have a recent claim denial to work from as to why and what a lawyer would need to challange.

Social Security will help for children who are unable to work as well but I do not know if that will qualify her. The thing with SSDI is once you apply continue through the appeals process. DO NOT start back at the beginnign each time. Almost every application is turned down originally, it's when it is appealed that it is really looked at. I have a friend who's daughter is on SSDI, but she has a physical disability, that while an extremely bright child, has kept her from doing many things children her age woudl normally do. Thankfully, every tiem I see her she seems to be better than the time before, but what she has is supposed to be progressive.

is she in public or private school? Unless she is labeled by a doctor as retarded, then she doesn't need to get a check. If it is not causing a financial hardship to school her or take care of her then there is to be no check. When SS denied you they should have sent you a letter or told you in person or on a phone call the reason(s) why she was denied.

it was my understanding that you had to work to earn s.s. in a fund before you could collect it. She has not worked so there for can not collect. As a mother and father it is your job to provide for her not the states. you may ask the state for help if the provisions need are more than what your saleries can handle. This is how the systom is set up to work.

The social security administration provides for retirees, disabled adults who can't work, minor children whose parents have died but I've never heard of them being involved with children with learning disabilities.

There are likely government agencies who will help but I don't think it's the SSA.

i wouldn't worry about getting a damn check for your daughter,,, i would worry about how i was going to EDUCATE your daughter. MONEY isn't everything!!! she can be TAUGHT!!! and a ssi check isn't going to make her ADD go away... sit with her everyday and TEACH her!! Mentally challenged kids are acting on TV now, so a child with ADD can surely learn! Spend as much time trying to teach your daughter as you do in trying to get her on SSI!!!! (once shes on it..then what???? do you think she will automatically get SMART and pass KG???) its YOUR responsibility to teach her to learn!!!!
