It hasn't worked because Congress kept giving it.
Why? Partisan politics. They held their allegiance to their political party as more important than their Constitutional obligations to be an independent branch of government.

I think to throughouly answer your question you have to point out a more meaningful question?
When you mention checks and balances are you talking about each individual who has a checking account, or are you talking about the Nation's budget and the government?
If you do on this part of view, we must say that not everything is 100% official. We go every year trillion's of dollars into our nations debt. And there seem's to be no end to the war in Iraq. I think what happens is that the Bush administration or any administration forgets what is important or what is not important. Cause, no one exactly has the key answer nor the solution to the National budget. However, why checks and balances haven't worked out is that the government officials have not particulary experienced or done enough research to adequatley eliminate the deficit and balance the Nation's budget. I think somewhat the government hands are tightened with this subject. We add more to the budget but never seem to find a solution to pay thedebts that we owe for centuries.

Last 2 years .. who controlled both sides of congress?
Repuublicans.
Those who have control get to set up the committees and lead or kill investigations, proposals and basically do whatever they want.
So for 2 years before last novembers elections republicans allowed the president to do whatever he wanted..
They gave billions and billions away to their friends in civilian contracts with no bid awards, just straight gifts.
Republicans had no oversight of the money they awarded.
Billions went unaccounted for in IRAQ
Those FBI wire taps went on, with no one questioning it.
Heck republicans were even able to toss in internet gambling illegal attaching it to a larger bill to get it past.
But bottom line is that since president house and senate were all republican controlled, it meant that anything the president wanted to do, fair or not, he could with no oversight and no accountability.
Thats why now that democrats control the house of reps, youre seeing all this stuff come up...because they can control investigations now.
BTW -- Everyone defending this administration and the attorney General says the president himself was never informed or is not involved in this.....so how can conversations or discussions or communications between 2 parties with the president not involved be argued as Executive priviledge when President or Vice President is not involved?
Bush is making everyone think he has this executive privilige card to play, but it doesnt apply

Good question. I'm not sure that there is an answer.
But why didn't checks and balances work late in 2000, either? That is, why didn't Pres. Clinton react to the Supreme Dictators' ruling in Bush v. Gore by proclaiming that the Supremes were liars and cheaters and that their "ruling" won't be respected or enforced by his administration and that the Florida officials should disregard the Supremes and just continue counting the ballots?

They are sellouts. In fact they are getting ready to double the taxes on legitimate Americans if Harry Reid has his way and give amnesty to illegal aliens, forcing more burdens on the American family. Call, fax, email and write letters of protest. Go to the march nest Month called: Hold Their Feet to The Fire! Show up at their offices and homes in mass numbers!
