I married my same sex partner in June of 2005. She is a Canadian citizen and Im an American citizen. We seperated shortly after and now Im living back in the United States. My wife refuses to send me divorce papers even though we're both in new relationships and have been separated for over a year now. I dont have a job at the moment. What's the best way to go about getting divorced?

Most states in the U.S. do not recognize same sex marriages. Therefore, no court here will divorce you. That means you are free to go carpet munching elsewhere.

Even thought most US states don't recognize same-sex marriage - most do have something called a "domestic partnership dissolution." This is like a divorce for people who were never married and is used lots of times by gay couples. It is a way to get the court to separate property and to declare that the relationship is officially over. Especially important if either partner was received domestic partner benefits from an employer.

Where did you get married? Get a hold of the officials there and ask the same question. If it was in California, I am sure San Francisco would send you a divorce certificate or application if you asked. Are there children involved?

If you got married in Canada you'll have to check the laws pertaining marriage and divorce in Canada. The best way to go about getting a divorce in YOUR case would be to get a lawyer.

Ummmm...is it even legal? If not, go be with someone else. Same sex marriage isn't legal is it? I am not against it. To each his own. But I didn't know you could do it!
