My in laws own my home, hubby and i seperated, they tried to evict me on some crazy 2 day notice, then filed a Writ of Summons, says they want me to vacate house, and list damages, but no dollar amount, or specifics. No court date yet, came home on Monday, they changed the locks and have all of mine and my childrens property. I need to file this statement of defence by tommorow with the court registry, any advice, other than get a lawyer!!!

under these conditions take no chances and hire a lawyer. You may be entitled to legal aid if you are now supporting yourself and children on your own income. in most states it is a crime to change the locks on a door before the person has had reasonable oportunity to vacate. check with the local police and see if there is anything they can do in the meantime.

The Summons is part of the Complaint, which sets forth what they are claiming, and what they are asking for.

Your response can do either or both of two things. You can deny specific allegations in the Complaint, saying they are wrong. Or you can assert a legal (affirmative) defense which says that you are entitled to stay.

You really should consult a licensed attorney, becuase its very easy for a layman to lose a lawsuit on procedural grounds, which could result in you being evicted.
