I was on my break at my desk and i was telling something to my co worker and this manager came up to me and thumped my head and yelled to stop talking? This manager is most of the time very unprofessional especially if shes in the bad mood. do you think i would be able to file a complaint on this? where?

for more info, i was not slacking. i was the last one who took my break coz i finished all the assigned work.

This company is a call center plus its dominated by ethnic groups such as Albanians, Romanians and Russians. There is only one person who works in HR> and shes new.

I ABSOLUTELY think you have every right to file a complaint. But before you do, I think you need to ask yourself if you are ok if this causes you problems, because if she is that unprofessional I wouldn't expect her to deal with it well. But if you are up for the fight, there are 2 ways you can do this, both with their pro's and con's.

You didn't say how large a company this is. Is there a Human Resource manager or perhaps someone accessible in management? Who is HER boss? You could either put in writing what happened, how unprofessional you feel this is and how it reflects her behavior and how you don't feel you should be physically abused in the workplace. If you put it in writing, if they fire you, then you are covering your butt by saying it is retribution for filing a legitimate complaint. The other way would be to go discuss it with whoever the boss would be. The good side to this is you could use it as an opportunity to shine, to show you don't want to be a trouble maker, but you expect to be treated professionally and safely. The downside is you wouldn't have anything in writing if anything goes wrong.

Without knowing the people there, how powerful the "thumper" is, etc I wouldn't want to risk suggesting what you should do. But since you know them, I'd think it over, maybe talk to a trusted co-worker and decide what makes the most sense for you. And while there are various outside agencies where you could file a complaint, if you want to remain working at that company I wouldn't do that as I think it would reflect poorly on you as a trouble-maker.

But I definately think she was WAY out of line and should never touch you. Imagine if it was a guy that did this? It's 100% wrong to lift a hand to another at work and should be stopped. You should not have to be treated that way at work and I would hope the higher ups would understand that, and the legal ramifications of allowing an employee to treat another that way.

Yes. Make a complaint to her superior. You might want to charge her with assault. Not only did she physically abuse you, but she yelled at you. These are acts which make the workplace intolerable. You should take this complaint all the way to the place where she loses her job. If your company has a human resources department, go there. The longer you wait, the more likely upper mgmt will blow you off. If there is no one above her, then you should call the attorney generals office and find out how you can proceed . The emplyment security department might be able to answer some questions. Basically, she has attacked you and made the workplace unsafe for you. GO FOR IT!!!!!!

Check with your state's Labor Relations Board, or with the EEOC (start with the state). If you are serious about filing the complaint, I suppose the matter could be considered battery and you could file criminal charges. However, you will soon need to choose between getting angry, getting even, and getting out. Make that decision BEFORE you get all tangled up in filing a complaint.

You might let it slip into the conversation that you REALLY don't like that, and that you did visit the state labor relations board's office to see what you should do about it... don't threaten, just do. This might get the message across, or it might get you in deeper trouble with them.

But where does thumping end and punching start? It isn't appropriate behavior and you do not have to put up with it unless you choose to.

Of course you could file a complaint. Companies watch their employees carefully, but watch their employee supervisors even more. Go to your HR (Human Resources) department (or call the phone#) and tell them this. Try to sound professional; use words like "disrespectful, uncomfortable, unwanted touching, unprofessional,"etc. Just don't exaggerate because they'll look into it, and you don't want to be made a liar. Don't sound like a little kid complaining about a non-big deal.

Hell yeah! File the complaint! Don't know how big your organization is but starting with her boss is usually the next step and work your way up the "chain of command" or perhaps just going straight to Human Resources might be an option, too.

DEFINITLY! you have the right to file a complaint with your Human Resources department. if they won't help you, then you can take it to the labor board and sue. yes, you may lose your job temporarily, but once the courts find her guilty, you'll get ur job back, and she'll be HISTORY! in the mean time, keep a journal, and log down all the cruel and mean things she does. then, you will have a papertrail when the time comes, to prove all the **** she did to you, for each entry, put witnesses names, the time and date that the incident occurred. she'll be canned before you know it!

Definitely file a complaint! Do you have a Personnel or Human Resources department? Talk to them...

Go to human resources or her boss and explain what happened, they will document the incident. If you really want to get her file a complaint with the police for assault.

If you feel like your manager is making your job a hostile environment and definately when you complain say that she's making it a hostile environment cause that means a lot when complaining about someone who works with you, but yea that would piss me off too you are not her child.

Hell yes it's acceptable. You could even go as far as to charge her (criminally) with simple battery if you wanted. Nobody has the right to hit anyone unprovoked. Something needs to be done about this person.
