If you shot someone in an altercation in self defense, what would the punishment be? You are charged with murder until the jury can prove it was self defense. I know in the state of Texas there is a license to murder law. So, why does someone get treated like a murderer for defending himself if he was previously knocked unconcious? Can anyone give me any advice?

Yes. Get a good lawyer and do not rely on answers here. That is pretty serious stuff.

Texas is a State that does have self-defense statues, but if someone was shot and charged with murder, then the D.A. has reason to believe other than self-defense, which is why they are charging for murder.

Texas also has the death penalty. Like the poster above indicated...you need a good criminal lawyer, not Yahoo Answers!

Self-defense means "self-defense in proportion to the threat." If someone shoved you, and you shot them, it's pretty much murder. If they pulled a knife and said, "I'm going to kill you," it's self-defense. If you were knocked unconscious, woke up, went home and got your gun, came back and shot him, that's murder. If you woke up and he was standing over you with a sick smile and a hunting knife, that's probably self defense.

Also, Texas? If he was a black man, it's always self-defense. If you're a black man, it's always murder. Unless he was also black, in which case they just flip a coin.

It depends on the conviction and what the prosecutors want. First degree murder has a harsher sentence than 2nd degree (usually) and capital murder can be life in prison or a death sentence.

"self defense"-the key word. Homicide laws exist in every state....."knocked unconscious" previously-you need a lawyer.
