I have been fighting for my SSI for almost three years. Less than 1 year ago, after my second turn down (reconsideration) I took my medical records.....that I collected myself....to an attorney to hire him.....because I was anticipating having to go before the judge.

In the meantime, a great doctor of mine obtained a special form and submitted it for me....and got me approved. Now, there is no need for a hearing and I have been awarded.

So, the only thing this attorney has done for me is to file one form, that I could have easily done myself. My question is......does he deserve full commission, now?

Probably.. You shouldn't have hired him in the first place. You do NOT need an attorney to get on social security.

The attorney is at least entitled to hourly compensation for any time spent on your case, both filing and research/preparation.

As to commission on the award, that depends on the exact wording of any contingency agreement you might have had.

You might have been able to file it yourself. But you did hire the attorney, and like any other service contract, he gets paid for what he did.

That would depend on the contract wording you had with the attorney... and believe me you have a written contract with said attorney.. and likely its gonna say pay up and will be upheld in court.. so hey pay up OK?? (seriously.. yer either gonna pay him/her or yer gonna pay 3 other lawyers and loose anyway)
