I Hate my neighbor! I've been living in my apartment since 2003. Old neighbors moved out at the end of 2005. Never had an issue with them. Beginning of 2006, a 22 year old hood-rat moved in with her 4 hyper kids. In 04/2006: I went outside onto my patio to find piles of MAGGOTS crawling around. Were dropping down from her balcony where she had garbage and soiled diapers stacked. Manager notified. To make a long story short, they have thrown diapers, garbage, cigarettes, underwear and more on my patio. Plays music too loud, makes noise anytime of day/night, traffic in and out all night, kids up till 3AM running & jumping, people fighting at 2AM, bringing different men home having loud sex. Tried talking to her, she's rude & doesn't care. Knock on ceiling, they stomp back. I blasted heavy metal music and she banged on my door. Slammed it in her face. She spit on my car. She & 8 other people living there are not on the lease. Got evicted 3 months ago for non-payment of rent, won't leave!

~As near as I can tell, you are asking if you should join her in the loud sex. I wouldn't advise it, unless you make sure there are plenty of condoms and a can or two of Lysol.

If your neighbor is being evicted for non-payment, then you should have nothing to worry about within a month or two. Someone from the Sherriff’s office will forcibly have them removed.

However, since this has been going on for some time it is more likely that they are paying at least some of the rent so it is now down to a problem with you and your landlord or the police.

Understand that your landlord sleeps soundly each night at home and is totally unaffected by the noise/filth from your neighbor. Unfortunately, you will have to complain often and directly with the landlord or leasing office. The best route is to ensure that you take up someone's time in the office since the apartment company has to pay someone's salary to listen to you. Try to stay calm, but do visit & complain to them often enough to cause the company to take notice. They are likely to keep records of complaints. Encourage your other "good" neighbors to do the same. Bring photographs of the filth if possible because if there is a chance of a health hazard (not just nuisance) then you have more of a case to have them evicted even if they are paying rent.

The police may be willing to help also but only if they can see some pretty outrageous behavior firsthand from outside the apartment. Loud children stomping around at 3 a.m. won't be enough to take legal action, so use your calls to the police sparingly. Very loud music may get the police to knock on their door. If multiple people call the police (not just you) on this same problem, then the police will be able to take it up with the apartment complex directly. Just always remember to be polite and don't lose your cool. Don't confront the neighbors directly (even if only to knock on the ceiling). It will have no effect and only give them the ability to say you are part of the problem (especially since you say you blasted music yourself in retaliation). You want the issue to be between the neighbors and the authorities, not between you and the neighbors.

Other than calling the Police, I'm not sure you can do much of anything. This sounds like a matter for the landlord, and if he's not doing anything, the only thing you can do is start looking for another place to live.

They won't be around long. The owner of the property has the right to have them physically removed by the police after a period of time has passed. If you want to push the issue, contact local law enforcement and the owner to come up with a plan.

Unless you're the landlord, nothing you can do besides complain to the landlord or leave if you're not happy living there.
