A fellow employee called me some vulgar names, I replied saying he was being a bi@#$. He then hit me, we were both sent home, anyone think I am at risk for being fired?

I work in a warehouse, and there was one witness to the situation, not sure if he wants to get involved or not.

If there are witnesses that can confirm your story that he hit you first, then he should be terminated for assault (you can also press charges against him as an individual should you desire.)

You may receive a disciplinary action for allowing yourself to be drawn into settling a disagreement by brawling. If it ends up being the other employee's word against yours, you may well be terminated because the employer won't be able to determine who instigated the situation and thus who is really at fault.

yes, you are at risk. You should not have responded the way you did. They might fire you both just to make sure there are no more problems. Like it or not, you need to learn to walk away when you are at work.

Since you were the victim I doubt you would be fired.Unless you were both fighting for a prolonged period,then maybe they could terminate you for fighting too.
