With hold visitation from the non- custodial parent due to the child having a broken arm? It is our visitation weekend and my son has a broken arm his mother is refusing me visitation for 2 weeks due to this. However, she is sending him to daycare for those 2 weeks. Can she do this?

My son comes home weekly with injurys from daycare including the broken arm. Im his parent and think I can care for him for the weekend just as well as his mother could. I think if he is going to go to daycare where kids pick on him and push him down. Its not unreasonable to think he would be fine laying on my sofa watching cartoons.

hell no she cant but theres not much you can do to take her to court it will take 30 day... BUT DO GO BACK TO COURT. and by this time your visitation weekend is over but pls dont let her do this my x did the same would not let the kids come if it is raining this is your time with your kids and if you work like most men do. its the only time you can spend with you kids she cant make up the days cuz you work and you allready get the kids everyday your off work . dont let her do this to you and your kids . not that it matters but did you son brake the arm with you.or her.... good luck man.. if you let her do this your asking for more ...and more of the same crap.put a stop to it now let her know you will not play her game .. me and my x meet half way at berger king if she is not there i get a coke to show the court i was there at that time and she never came there ....do you have a lawyer... get one

No she has no right to withhold your visits for a broken arm. I would definitely talk to her first about the written order that you have, and if she is not willing to adhere to it then inform her that you have no choice but to involve the courts again.

Secondly, if your child is coming home with repeated injuries from daycare then there is a problem. I would contact the licensing body for daycares in your state and report an ongoing problem. You are the child's father and you have a right to know that your child is being properly cared for when he is not with you.

I applaud your involvement with your son - more fathers need to be involved in their childrens lives after seperations. I do not how ever applaud the childish behavior of your ex who seems to think the boy is property she can weild some sort of exclusive control over.

i wouldnt worry about what "the lawyer" said, if thats the case who is to say his mother is qualified in post-traumatic care?
there is no reason to hold the child unless you are somehow responsible for the child's broken arm or the court says you cant care for the child. the best thing you can do is talk to a lawyer if you cant afford one try legal aid

You have not answered the relevant question: does she have reason to believe you are not capable of taking care of your son while he has a broken arm? The daycare people are trained and capable. What's your training in pediatric trauma aftercare?

I would asssume that you would have a case, but why would you want to? Its only for 2 weeks and he'd end up "lying on your couch watching cartoons".....Unless you really want that drama
