Because people are easily manipulated. They can be tricked into responding based on purely emotional reasons, without really understanding the legal issues involved.

That's why it's usually left up to the courts, who take the long view and understand the consequences of such choices.

The courts also safeguard the interests of the minority groups, as opposed to temporary majorities who are usually only concerned with getting their own way.

People are willing to give up freedom from having their bags searched, and their marijuana found, in order to have terrorists bags searched, and deadly weapons cinfiscated, to keep them from killing innocents.
