Ask him . . . . .

Yes anyone can file for divorce without the others permission or knowledge of the filing until the other receives the papers. Why do you feel like this? Has he said something to make you assume this? What I would do if I were you be up front with him and just ask him if this is what he is going to do. Don't you think being up front with this man is a lot better than worrying about it.
When a person files for divorce it is only public record after the lawyer has filed the paperwork. A person can start the procedure and tell the attorney to hold off on filing until a later date. So be honest with how you are feeling with him, this is the best way to go about it.
You are the only one who can tell if he is being honest with you and trust your instincts.
Good luck with what ever you decide to do.

I filed for a divorce from my first husband and he did not know it until the divorce papers were served to him at the front door by the sheriff. If you want to know for sure whether your husband is getting a divorce then you should ask him so you can be prepared.

He can file for divorce without you knowing. If he is straight up you will know, but if he decided to be underhanded there are ways to actually get a divorce without the other party knowing. Will it be legal? It depends on which attorney has the ear of the judge if it is ever questioned.

Divorce is just the final step! Not the first. If you THINK he's thinking of leaving you, then now is the time to figure out if you're right or not. Don't wait to be served with divorce papers to figure out what's going on!!!!

My wife's ex-husband divorced her without her knowledge. While they were separated he had all the papers sent to an address he knew she no longer lived at so when she never showed up for any of the court appointments they granted him a divorce.
