my husband is in the military and i have a child with someone else. we plan to move out of the country with my husband but dont know if im able to take her. we have no kind of custody papers or anything and he doesnt pay child support.

Whose name is on the birth certificate, in most cases when you are going out of the country you have to have permission of the father.

I had a friend who just went through the same thing. In order to get a passport, her child's father had to sign papers. If your child's dad signs, it won't be a problem, but if he refuses, you'll have a hard time.

It doesn't make any difference if he pays child support or not--he still has a say, which I know is ridiculous.

You should also consider how it will affect your child--if he or she has a relationship with the biological father, it might not be fair to take that away, even if the dad doesn't pay.

The military or law isn't going to break up your family due to military orders. and in your case with no legal papers or anything then there is not a lot the father can do. Make sure you do the right thing and let him know how to contact you.

If you had a child by another man that you were never married to and the man that your married to now is raising the child then you can take the child anywhere you want to. The child's natural father is not being responsible.

if paternity hasn't been officially claimed (through dna testing) which is what the courts would do to establish paternity (giving him parental rights to your child - even if you were married-a father should still do this by the way---and to get child support) If this hasn't been established, then you do have the right to take your child out of the country.

it depends on where you are going if you are leaving the country where you need full custody then maby but if not i dont know
