My job requires me to obtain and retain several types of expensive certifications. My employer pays for them but I have to sign a contract every time I get one agreeing to pay them back if I start a new job within 1 year of obtaining that particular certificate. If I did quit before that year was up, can they keep my last check or is there a min. amount by law that they are allowed to hold ?

Many employers insist they can do this, but they can not. Deductions can NOT be made from your pay that will bring you below the minimum wage.

You can contact your local department of labor, or check their website for more information. Use the term "deduction from pay" and that should help you find the correct answer to your question.

I do question the " 1 year " clause. How big an area does it cover.???

A 1 year requirement is common, but it is usually spelled out, like you can't get a job with a competitor or customer within a 25 mile radius.,


I'd clear this up.

It's there call. The negotiation should go like this. If you get the certification you should receive a raise. See if they like that. Commitment and tango takes two.

What they can do, is to withhold the money from your last paycheck that they paid for the certifications, especially if you signed an agreement on this.

OF COURSE THEY CAN.
THEY PAY FOR THE TRAINING AND EXPECT A RETURN.
THEY CAN GET TOTAL AMOUNT OF TRAINING PLUS YOUR TIME LOSS FROM JOB ATTENDING..
SOME TIMES TRAINING =MANY THOUSANDS OF DOLLARS.
