Anyone out there has any experience with this issue. My current boyfriend has an ex spouse.. never married with 11 and 14 year old boys.. he has provided her with payements for over 3 years since separation. His ex-spouse who is the custodial parent refused to get a job and depends on my boyfriend for not only the kids but her welfare.. can anything be done about enforcing her responsiblity to provide as well?

The courts normally consider that if the mother is providing housing, heat, food, hair cuts, schooling, transportation, medical care, and other expenses that she is doing her part. The support order your boyfriend is paying under should have used his income and what the court deemed to be her income to compute the child support amount. This is pretty standard in most states.

Why doesn't he go to court and get custody of the kids?

depends on what is written in the final decree and it is up to your boyfriend not you on what happens there.
