Sounds like a state law issue to me. Some properties grandfather access to certain individuals/companies, etc. because of a clause in an agreement from way back when. I think I'd take a look at the property deed, first, and then research through the land office.

Each state codifies their real estate laws different however the main principles behind real estate law is basically the same. You'll need to check your state's real estate laws relating to your particular situation.
