It's not the judge's fault. It's not up to them.
Federal law preempts state laws. Period. Federal law makes marijuana illegal. Period. With no exceptions.
Congress could make an exception for prescription medical use at any point. Congress hasn't. That's their fault.
It's amazing. When judges follow the law, people blame the judges if the laws are bad. And when judges bend the law in the name of justice, people blame the judges for usurping the power of the legislature. Make up your minds.

Because people are just mean and heartless. They don't limit their cruelty to dying people. They also manage to inflict their cruel heartlessness on animals, mentally incapacitated people, gay people, old people, people of another color, people of another religion... I could go on. If we didn't have all of these mean, cruel, heartless people, we would be living in a world similar to heaven I should think. Not supporting these horrible people by any sense, just saying it like it is. People are mean. Now, that said, judges do not make laws. Judges can only uphold law. If we want laws changed, we have to go to our legislators. But, yes, making marijuana illegal is stupid. If both drugs and prostitution were legal, the whole system could be regulated and taxed. The government could make money off of the whole thing and give a big break to a lot of over-taxed Americans as well as regulate the health of the whole situation, but these people who still, for some reason, think that God has a place in government cannot support such an "immoral" lifestyle and would rather punish the innocent along with the guilty.

This is the glory of democracy. Isn't it so obvious why we're spreading this other countries around the globe?
Anyway, this is unfair and unjust. Morphine is a HIGHLY addictive substance as it oxycotin, but these are prescribed to people all the time. Why not throw in some pot... it's non-addictive and you would have to inhale 1500 pounds in 15 minutes to die from an OD.

personally i believe that this is a situation where someones interpretation of morality is infringing on the civil rights of others.
i think all drugs should be legal. however hold people responsible for any actions they may make. nobody should have the authority to tell me what i can and cannot do with my life, that is slavery.
p.s. no i don't use harmful drugs =D (except alcohol on occasion) i only support freedom. ethics and morality simply should not have any pull on law. law is only mean to protect people from damage inflicted by others.

This decision is an aberration of justice and individual liberty. States are passing laws allowing medical marijuana use, yet the feds are essentially saying - damn State's rights. This decision is further illustration of the erosion of individual liberty and State's rights.

I agree. I have a condition which *does* qualify me for medical marajuana, but there's *no way* I want my name on a govt list for that!
If my doctor can prescribe morphine, why not pot?
