It would be taken into account that he has a child, but his partner would be expected to contribute to both their child and her own, so he would still have some income that wasnt 'protected' and would be liable to pay child support. But it depends on how much he earns as well, so if hes a low earner it may not be very much.

This isn't true and do not listen to him. It doesn't matter how many kids he has, if you were to take him to court for child support, he would still have to pay. My daughter's father has more than one kid and the money that is deducted from his payroll check is divided between the kids. Sometimes it isn't much but every little bit helps. If he hasn't given you one dime for your daughter her whole life, why haven't you gotten the ball rolling and taken him to your local court to file for support? It doesn't matter if you need it or not. We as women can be independent when raising a child, however the fact still remains that it can be a real struggle trying to provide unless you are well off financially. In my opinion, you should not be letting him off the hook by accepting his non support. This is a child that the both of you created together, and should both be taking care of equally. He has an obligation as a father to provide for her. Think things over for the sake of your daughter. People do not think long-term as far as these situations go. If he is working and entitled to benefits or social security, and for some reason have an untimely death, your child can be elgible for social security monies as long as she is a full time student. Just something to think about and possibly reconsider.

This is not true ,how can he say that ,he just does not want to pay for that child so u have to fight for the right of Ur child he has to know that he has responsibility and he has to face it ,though u don't need anything from him but what does the future hold for ur child,he is the father of that child and u have to stand for the her,now not later take him to court let him be resposible for that child, she will be with u but he has to pay on her,u didn't bring this child alone ,so no way will run for the expenses do something now and quick, because he tell u that she is not mine ,and this will really hurt that poor gril later ,so pls take care.

He's talking out of his bottom. Your maintenance payments will be reduced because there are 2 kids in the house that he is presumably supporting, but he will still have to pay maintenance for his daughter with you. Does the woman he lives with get maintenance for her other kid from its father do you know?

Phone the CSA! what might surprise you as it did me at the time was that my ex had to pay for my child his blood relative but the CSA allowed him a certain amount a week because of his new partners two children. This is one point that made me angry he wasnt even their father but the CSA counts them as such because they all live together !!
He has to pay for your child until she is 19 and they can get the arrears for you as well.

Any judge will tell him when he gets to court, that he had the responsibility of his first child or children before he got married the second time and had children. Just because he has children with another woman doesn't change the fact that he is financially responsible for every child he has. period.
I know this from experience!

Oh that is sooo wrong. It doesn't matter if he has 3 kids with 3 different women he is still has to pay child support. Don't take my or his word for it, contact your local child support enforcement agency and get the facts.

Good luck and God bless!

My mother never got a penny from my dad when we were growing up, I dread to think how much he'd owe in total. I think your ex is trying his luck, give the csa a call. Although the csa are rubbish but hey, give it a go.
